Tax Consulting
Peter Bembrick is a highly respected authority on taxation and accounting matters with close to 20 years experience. Peter joined HLB Mann Judd in 1990 and became a partner in 2004.
Peter is particularly well regarded for his broad understanding of domestic and international taxation regimes. This includes specific expertise in the areas of:
- CGT small business concessions, with an emphasis on tax effective business sales and restructures
- business structuring issues, including advising on CGT, GST and tax consolidation rules
- corporate taxation, including the specific issues faced by subsidiaries of multinational groups
- taxation rules for listed investment companies (LICs) and the specific provisions governing the tax treatment of capital gains and concessions available for shareholders receiving dividends from LICs
- transfer pricing associated with cross-border transactions and the proper documentation of transactions so as to comply with regulatory requirements.
- expatriate taxation, including tax issues faced by businesses sponsoring individuals working in Australia under temporary visa arrangements (such as class 457 visas)
- Peter’s broad understanding of Australia’s taxation regime is demonstrated through his comprehensive work relating to the sale of a significant heritage-listed property in Sydney. A thorough investigation of the relevant company’s direct and indirect ownership base provided the basis for a private ruling from the Australian Taxation Office regarding the CGT treatment of the company’s assets. This private ruling proved critical in structuring the sale of the property in way that largely eliminated the payment of tax by the company as a result of the sale. Peter also advised on GST issues related to the sale, and was successful in obtaining an informal ruling from the ATO to ensure that the sale was GST-free.
- Peter’s opinions and expertise are widely sought after by industry and peers. He has served on a number of advisory committees for the Institute of Chartered Accountants in Australia including the National CPE Tax Advisory Panel, and has written numerous articles for various business publications. His views and comments are continually sought by business journalists writing for Australia’s major daily media outlets.
- A results-driven practitioner recognised throughout the industry for his practicality and accessibility, Peter is known for providing solutions that are technically robust and highly commercial.
