Alternative Dispute Resolution (ADR)

We act either to assist one of the disputants or as the neutral third person in a variety of ADR forms:

  • Negotiation

  • Mediation

  • Collaborative practice

  • Early neutral evaluation

  • Case presentation

  • Conciliation

  • Independent expert appraisal

  • Arbitration

  • Hybrid – where say arbitration and another process are combined

  • Expert determination.

In some instances, an ADR process will occur without settling all issues but will at least narrow the issues for later negotiation or for a court or other imposed decision.

Critical personal skills required in acting as a mediator or other third person neutral:

  • Ability and willingness to listen

  • Identification of the important issues

  • Commonsense, patience, creativity, lateral thinking and persuasiveness

  • Option generation

  • Objectivity, neutrality and trustworthiness.
